Your plan may include some or all of the following legal documents:

  • Will – Everyone should have a will. If you die without a will, state law will determine how and to whom your assets will be distributed and if you have minor children, who will be their guardians.
  • Trusts – There are many types of trusts to accomplish different goals.
  • Durable Power of Attorney – You may appoint someone you trust to make your financial decisions should you become incapacitated.  Without a power of attorney, you and your family may be involved in a probate court proceeding where a judge determines who will make these decisions for you.  Powers of attorney can be “immediate” or “springing.”
  • Healthcare Power of Attorney – You may appoint someone you trust to make your medical decisions should you become incapacitated.  You may also include directives on the type of medical care you would want if you become unable to make your own decisions.  Without a power of attorney, you and your family may be involved in a probate court proceeding where a judge determines who will make these decisions for you.
  • Living Will – Living wills allow you to state in advance your wishes concerning life-sustaining treatment.  The living will is relied upon only when you have a terminal condition and cannot communicate your wishes.
  • Special Needs Planning – Focuses on providing for the special needs of your loved ones with disabilities.  There are estate planning options to help with all of the legal, financial and special care needs of your loved ones.
  • Asset Protection – We can assist you in making the right decisions to help protect your business and assets from lawsuits, creditors and bankruptcies.
  • Charitable Planning – We can assist you in making charitable gifts in the most tax-friendly manner.
